The Nature Conservancy (the “Conservancy”) takes your privacy very seriously and cares about how your information is collected, used, stored, and shared. We are providing this Privacy Notice to explain our practices and the choices that you can make about the way your information is used by the Conservancy.   • Disclosures of Personal Information.  We may share personal information to service providers, partners, affiliates, co-ops, and advertising partners. See the section “How We Share Personal Information” for more information.
  • Retention of Personal Information. To determine the appropriate retention period for personal information, we may consider factors such as applicable legal requirements, and the amount, nature, and sensitivity of the personal information.  See the section “Retention of Personal Information” for more information.

We may update this Privacy Notice from time to time in our sole discretion. If we do, we’ll let you know by posting the updated Privacy Notice on our website, and/or we may also send other communications about such updates.

 

PERSONAL INFORMATION WE COLLECT

We collect personal information that you provide to us, personal information we collect automatically when you use the Services, and personal information from third-party sources, as described below.

 

A.    Personal Information You Provide to Us Directly

We may collect personal information that you provide to us.

  • Engagement with Our Services. We may collect personal information in connection with your engagement with our Services, including if you volunteer, sign up for a membership, take action on or complete a survey, sign up to receive updates about the Conservancy’s work, or log in to one of our mobile applications. This personal information may include your name, email address, mailing address, phone number, other contact information, and other information that you voluntarily provide to us.
  • Donations, Gifts, and Other Transactions. We or our third-party service providers may collect personal information and details associated with your donations, gifts, and other transactions, including contact information and payment information. Any payments made via our Services are processed by third-party payment processors. We do not directly collect or store any payment card information entered through our Services, but we may receive information associated with your payment card information (e.g., your billing details).
  • Your Communications with Us. We, and our service providers, may collect the information you communicate to us, such as through phone, text, postal mail, email or our web chat tool. 
  • Surveys. We may contact you to participate in surveys. If you decide to participate, we may collect personal information from you in connection with the survey such as your survey responses. Depending on the survey and how you choose to respond, survey responses may include sensitive information such as demographic data that you voluntarily choose to provide.
  • Interactive Features. We and others who use our Services may collect personal information that you submit or make available through our interactive features (e.g., messaging features, commenting functionalities, forums, blogs, and social media pages).  Any information you provide using the public sharing features of the Services will be considered “public.”
  • Sweepstakes or Contests. We may collect personal information you provide for any sweepstakes or contests that we offer. For example, we may need to collect your contact information such as email address, mailing address, or phone number to notify you if you win. In some jurisdictions, we are required to publicly share some information of sweepstakes and contest winners, such as the winner names.
  • Conferences, Trade Shows, and Other Events. We may collect personal information from individuals when we attend or host conferences, trade shows, fundraisers, and other events. The personal information collected can include attendees’ government issued IDs to make travel arrangements, dietary restrictions or preferences, travel or hotel reservation information, or other information provided by attendees. For example, you may provide us with your contact information and dietary restrictions if you attend an event hosted by TNC where food is provided.
  • Projects. You may provide data to the Conservancy if you participate in one of the Conservancy’s conservation projects. For example, if you are a farmer participating in a Conservancy project, you may provide us with your land ownership information as part of the project.

 

B.     Personal Information Collected Automatically

We may collect personal information automatically when you use the Services.

  • Device Information. We may collect personal information about your device and browser, such as your Internet protocol (IP) address, user settings, cookie identifiers, other unique identifiers, browser or device information, Internet service provider, and location information (including, as applicable, approximate location derived from the IP address and precise geolocation).
  • Usage Information. We may collect personal information about your use of the Services, such as the pages that you visit, items that you search for, the types of content you interact with, information about the links you click, the frequency and duration of your activities, and other information about how you use the Services and your online and mobile activity.
  • Cookie Notice (and Other Technologies). We, as well as third parties, may use cookies, pixel tags, and other technologies (“Technologies”) to automatically collect personal information through your use of the Services.
    • Cookies. Cookies are small text files stored in device browsers. Cookies allow companies to recognize your device and store information about your account and preferences.
    • Pixel Tags. A pixel tag (also known as a web beacon) is a piece of code embedded in the Services that collects personal information about use of or engagement with the Services. The use of a pixel tag allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement.
    • Web Beacons. Web beacons are the result of a tag’s code firing. We may include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.
    • Other Technologies.  Other technologies used to collect information about your online and mobile activity include, for example, server logs, java script-based tools, and SDKs and mobile advertising IDs.

We and third parties may use these technologies for a variety of purposes, including to set your preferences, conduct analytics, provide enhanced functionality and personalization, and improve the performance of the Services. For example, we may capture how you use and interact with our Services using technologies such as session replay to improve and troubleshoot our Services. We and third parties may use these technologies to target advertising to you on and off the Services, including based on information about your activities across different websites and services and devices.

C.     Personal Information Collected from Third Parties

We may collect personal information about you from third parties. 

  • Service Providers. If you interact with our Service Providers, they may provide us with your information to provide the Services. For example, if you provide your contact information to a consultant who is interviewing participants for a Conservancy project, the consultant may provide your contact information to the Conservancy so we can follow up with you if needed.
  • Third-Party Services. If you access the Services using a Third-Party Service (e.g., third-party websites, applications, services, products, and technology), we may collect personal information about you from that Third-Party Service that you have made available via your privacy settings. For example, if you comment on a social media post by the Conservancy, we may take your feedback into account to improve our Services.
  • Users of the Conservancy’s Services. Users of the Services may upload or otherwise provide personal information about others. For example, if someone purchases a gift Conservancy membership on your behalf, they may provide us with your name, mailing address, and email address so we can contact you about the gift membership.
  • Related Third Parties. We may also receive data from other nonprofit organizations, community organizations, indigenous organizations, or other third parties related to the Conservancy’s conservation projects. For example, if the Conservancy is partnering with a local community organization, the local community organization may share project participants’ contact information with us so we can help coordinate the project participants for a local event.

We may also collect personal information through engagement in and with data cooperatives (“Co-Ops”). These Co-Ops consist of likeminded organizations (such as conservation nonprofits or organizations with supporters likely to support conservation efforts) that collaborate to enhance their outreach and marketing activities. Through these Co-Ops, we may receive or share personal information about individuals who have interacted with or supported other participating organizations, in order to send marketing or promotional communications such as postal mail. The information we receive from Co-Ops is used solely in accordance with this Privacy Notice.

If you wish to opt out of having your personal information included in such Co-Op activities or receiving marketing communications from us, please contact us as described in the Your Privacy Choices and Rights section of this Privacy Notice.

  • Public sources. We may also receive data from public sources, such as land records, for purposes such as tracking conservation efforts, identifying potential conservation areas, and understanding property boundaries.
  • Third parties supporting our marketing efforts. Additionally, we may receive data from third party companies to help make our marketing and fundraising campaigns more relevant. Depending on the campaign, that information can include your interactions with related organizations, geographic region, job industry, age, and similar types of data.

 

HOW WE USE PERSONAL INFORMATION

We use personal information for a variety of purposes, including to provide the Services, for administrative purposes, and to provide you with marketing materials, as described below.

 

A.    Provide the Services

We use personal information to fulfill our contract with you and provide the Services, such as:

  • Managing your information;
  • Providing access to certain areas, functionalities, and features of the Services;
  • Answering requests for support;
  • Communicating with you;
  • Sharing personal information with third parties as needed to provide the Services;
  • Processing your financial information and other payment methods for donations;
  • Managing your communication preferences and requests regarding your personal information; and
  • Allowing you to register for events and volunteering activities.

EU/UK GDPR Lawful Bases: If the EU GDPR or the UK GDPR applies to our processing of personal information under this section, our lawful bases may include performance of a contract, legitimate interest, consent, and/or compliance with legal obligations.

 

B.     Administrative Purposes

We use personal information for various administrative purposes, such as:

  • Pursuing our legitimate interests such as direct marketing, research and development (including marketing research), network and information security, and fraud prevention;
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity;
  • Carrying out analytics, including for digital experience and user engagement;
  • Measuring interest and engagement in the Services;
  • Improving, upgrading, or enhancing the Services;
  • Developing, training and fine-tuning models, algorithms and artificial technologies;
  • Creating de-identified and/or aggregated information. If we create or receive de-identified information, we will not attempt to reidentify such information, unless permitted by, or required to comply with, applicable laws;
  • Ensuring internal quality control and safety;
  • Authenticating and verifying individual identities, including requests to exercise your rights under this Privacy Notice;
  • Debugging to identify and repair errors with the Services;
  • Auditing, legal investigations, transactions, and other compliance activities;
  • Enforcing our agreements and policies; and
  • Carrying out activities that are required to comply with our legal obligations.

C.     Marketing

We may use personal information to tailor and provide you with marketing and other content. We may provide you with these materials as permitted by applicable law.

Some of our marketing activities may be considered a “sale” or “sharing for targeted advertising” under applicable privacy laws. Please see the “Co-Ops” and “Advertising Partners” sections of this Privacy Notice for more detail. If you would like to opt out of this type of sharing, please follow the instructions in the “Your Privacy Choices and Rights” section of this Privacy Notice.

California Shine the Light. If you are a California resident and have provided personal information to us, you are entitled by California law to request information once per calendar year regarding certain categories of personal information we shared with third parties for their direct marketing purposes in the past calendar year. D.    With Your Consent or Direction

We may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information, with your consent, or as otherwise directed by you.

HOW WE SHARE PERSONAL INFORMATION

We share personal information with third parties for a variety of purposes, including to provide the Services, to protect us or others, or in connection with of a major transaction such as a merger, sale, or asset transfer, as described below.

 

A.    Disclosures to Provide the Services

We may share any of the personal information we collect with the categories of third parties described below.

  • Service Providers. We may share personal information to third-party service providers that assist us with the provision of the Services. This may include, but is not limited to, service providers that provide us with hosting services, customer service, analytics, AI or machine learning services, marketing services, IT support, and related services. In addition, personal information and chat communications may be shared with service providers that help provide our chat features.
  • Third-Party Services You Share or Interact With. The Services may link to or allow you to interface with, interact with, share information with, direct us to share information with, access and/or use third-party websites, applications, services, products, and technology (each a “Third-Party Service”).

Any personal information shared with a Third-Party Service will be subject to the Third-Party Service’s privacy policy. We are not responsible for the processing of personal information by Third-Party Services.

  • Partners. We may share your personal information with partners such as grantors, universities, or government entities or others who jointly work with the Conservancy on projects in which you might be a participant. We will obtain your consent to collect and share your data when you participate in any projects.

Once your personal information is shared with our partner, it will also be subject to our partner’s privacy policy. We are not responsible for the processing of personal information by our partners.

  • Affiliates. We may share your personal information with our corporate affiliates.
  • Co-Ops. We may share your name and postal address with Co-Ops and third party service providers that manage co-ops to help spread our message and grow our donor base. These co-ops allow other likeminded organizations (such as conservation nonprofits or organizations with supporters who are likely to support conservation efforts) to contact our members by postal mail through a secure third-party service provider. In exchange, we also gain the ability to reach out to prospective members via this third-party service provider. In some circumstances, the likeminded organizations may provide us compensation in exchange for the ability to contact our supporters via postal mail, also through a secure third-party service provider.

In other circumstances, we may share your name and postal address with Co-Ops or other likeminded organizations to combine our respective supporter lists. This allows us and other likeminded organizations to keep you informed about causes, programs or fundraising efforts that may interest you. As part of these collaborations, you may receive marketing communications, such as postal mail from us or likeminded organizations, such as members of the Co-Ops, about their missions and activities.

In either case, the third-party service provider keeps all personal information confidential, and an organization is only able to obtain information about the recipient if the recipient chooses to respond to the third-party communication. If you do not wish us to make personal information about you available for this type of communication, please let us know by contacting us as set forth below in the Your Privacy Choices and Rights section of this Privacy Notice.

  • Advertising Partners. We may share your personal information with third-party advertising partners. These third-party advertising partners may set Technologies and other tracking tools on our Services to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this personal information (and similar information collected from other services) to tailor and deliver personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as “interest-based advertising,” “personalized advertising,” or “targeted advertising.”

B.     Disclosures to Protect Us or Others

We may share your personal information and related information with external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or requests, or other government requests; comply with legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual unauthorized or illegal activity.

 

C.     Disclosure in the Event of Merger, Sale, or Other Asset Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, purchase or sale of assets, transition of service to another provider, or other similar corporate transaction, your personal information may be shared, sold, or transferred as part of such a transaction.

 

YOUR PRIVACY CHOICES AND RIGHTS
 

Your Privacy Choices. The privacy choices you may have about your personal information are described below.

  • Email Communications. If you no longer want to receive emails from us, you can opt out of receiving promotional and/or marketing-related emails by following the opt out procedures at the bottom of our emails or by calling us at (800) 628- 6860 or emailing us at member@tnc.org.  Please allow ten (10) business days for us to respond to your request. Note that you will continue to receive transaction-related emails, like donation acknowledgements. We may also send you certain non-promotional communications regarding us and the Services, and you will continue to receive those notifications if you opt-out of promotional and/or marketing-related emails (e.g., communications regarding the Services or updates to this Privacy Notice).
  • Text Messages. If you no longer want to receive promotional and/or marketing text message from us, you may opt out of receiving future such text messages from us by following the instructions in the text message you have received from us or by otherwise contacting us as set forth in “Contact Us” below.  To learn more about our text/SMS messaging, please review our Mobile Terms and Conditions.
  • Mailing List. You may, at any time, choose to opt out of receiving postal mail from us by calling us at (800) 628- 6860 or emailing us at member@tnc.org. Please allow 30-60 days for your address to be removed from any mailings that are currently underway.
  • Telemarketing.  You may, at any time, choose to opt out of our residential telemarketing list by calling us at (800) 628- 6860 or emailing us at member@tnc.org. Please allow 30 days for your telephone number to be removed from any programs that are currently underway.
  • Mobile Devices. With your consent, we may collect precise location-based information via our mobile application. You may opt out of this collection by changing the settings on your mobile device and/or in the mobile application. To request deletion of your account, please use the standard deletion functionality available via the Services, in the app directly for apps with that functionality, or contact us using the information set forth in “Contact Us” below.
  • “Do Not Track. Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
  • Cookies. On the Conservancy’s main website, nature.org, you may stop or restrict the placement of Technologies by taking the following steps:
  1. Using your preferred browser, navigate to https://www.nature.org/.
  2. Depending on how you have previously interacted with our sites, a cookie banner may or may not pop up.
    1. At the bottom of the screen, you may see a banner at the bottom labeled “Your cookie preferences.” If you see this banner, click the green “Cookies Settings” button.
    2.  If you do not see this banner, click the green cookie icon at the bottom left of the screen to bring up the Cookie Settings.
  3. In the Cookie Settings, click the green “Reject” button.
    1.  Alternatively, you can toggle off specific cookie types using the toggles, and then clicking “Confirm My Choices.”

Please note you would need to follow the above steps for any browser you use. For example, if you only use Google Chrome, then you can just take the steps above in Google Chrome. However, if you sometimes use Google Chrome and sometimes use Microsoft Edge, you would need to complete the steps above for each browser to opt out of all but necessary cookies.

You may also stop or restrict the placement of Technologies on your device or remove them by adjusting your preferences as your browser or device permits. Please note that depending on how you adjust your cookie preferences, certain Services may not work properly.

Please note that cookie-based opt-outs are not effective on mobile applications. However, you may opt out of certain tracking on some mobile applications by following the instructions for Android, iOS, and other mobile operating systems.

The online advertising industry also provides mechanisms that may allow you to opt out of receiving targeted ads from organizations that participate in self-regulatory programs. Please note you must separately opt out in each browser and on each device.

Your Privacy Rights. In accordance with applicable law, you may have the right to:

  • Confirm Whether We Are Processing Your Personal Information;
  • Request Access to or Portability of Your Personal Information;
  • Request Correction of Your Personal Information;
  • Request Deletion, Anonymization, or Blocking of Your Personal Information;
  • Request Restriction of or Object to our Processing of Your Personal Information;
  • Request to Opt-Out of Certain Processing Activities including, as applicable, if we process your personal information for “targeted advertising” (as “targeted advertising” is defined by applicable privacy laws),  if we “sell” your personal information (as “sell” is defined by applicable privacy laws), or if we engage in “profiling” in furtherance of certain “decisions that produce legal or similarly significant effects” concerning you (as such terms are defined by applicable privacy laws); and
  • Be informed about third parties with which your information has been shared; and
  • Withdraw Your Consent to our Processing of Your Personal Information. Please note that your withdrawal will only take effect for future processing and will not affect the lawfulness of processing before the withdrawal.

If you would like to exercise any of these rights, please contact us as set forth in “Contact Us” below. We will process such requests in accordance with applicable laws.

Only you, or someone legally authorized to act on your behalf in certain jurisdictions, may make a request to exercise the rights listed above regarding your personal information. If your personal information is subject to a law that allows an authorized agent to act on your behalf in exercising your privacy rights and you wish to designate an authorized agent, please provide written authorization signed by you and your designated agent using the information found in “Contact Us” below and ask us for additional instructions.

To protect your privacy, we will take steps to verify your identity before fulfilling certain types of requests submitted under applicable privacy laws. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. Examples of our verification process may include asking you to confirm the email address we have associated with you.

Some laws may allow you to appeal our decision if we decline to process your request. If applicable laws grant you an appeal right, and you would like to appeal our decision with respect to your request, you may do so by informing us of this and providing us with information supporting your appeal.

If your personal information is subject to the data protection laws of the United Kingdom, you have the right to make a complaint to us about the processing of your personal data or in relation to the exercise of any of your rights at any time by contacting us at member@tnc.org. You also have the right to complain to the ICO, who can be found via their website (www.ico.org.uk) or by telephone: 0303 123 1113.

If your personal information is subject to the applicable data protection laws of certain jurisdictions, such as Australia, Brazil, the European Economic Area, or the United Kingdom, you have the right to lodge a complaint with the competent supervisory authority if you believe our processing of your personal information violates applicable law.

 

INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

All personal information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. These countries may or may not have adequate data protection laws as defined by the data protection authority in your country.  For example, if you visit our website from outside the US, your personal data (e.g., your IP address) may be transferred into the US.

If we transfer personal information from the European Economic Area, Switzerland, and/or the United Kingdom to a country that does not provide an adequate level of protection under applicable data protection laws, one of the safeguards we may use to support such transfer is the EU Standard Contractual Clauses.

RETENTION OF PERSONAL INFORMATION

We store the personal information we collect as described in this Privacy Notice for as long as you use the Services, or as necessary to fulfill the purpose(s) for which it was collected, provide the Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate purposes, enforce our agreements, and comply with applicable laws. 

To determine the appropriate retention period for personal information, we may consider applicable legal requirements, the amount, nature, and sensitivity of the personal information, certain risk factors, the purposes for which we process your personal information, and whether we can achieve those purposes through other means.

 

SUPPLEMENTAL NOTICE FOR EU/UK GDPR

This Supplemental Notice for EU/UK GDPR only applies to our processing of personal information that is subject to the EU or UK General Data Protection Regulation.

In some cases, providing personal information may be a requirement under applicable law, a contractual requirement, or a requirement necessary to enter into a contract. If you choose not to provide personal information in cases where it is required, we will inform you of the consequences at the time of your refusal to provide the personal information. 

The Conservancy’s processing of your personal information may be supported by one or more of the following lawful bases:

CHILDREN’S PERSONAL INFORMATION

The Services are not directed to children under 18 (or other age as required by local law outside the United States), and we do not knowingly collect personal information from children without consent of a parent or guardian. However, the Conservancy may receive a child’s information if that information is provided to the Conservancy by a parent, guardian, or donor. For example, a donor may designate a child as the beneficiary of a life income gift made to the Conservancy.  If you choose to designate a child as a beneficiary, please first obtain the parent or guardian’s permission prior to providing such information to TNC.

Occasionally, the Conservancy hosts a volunteer event or a contest that permits children to participate. In all such cases, the Conservancy will obtain the written consent of a parent or guardian before collecting the personal data of such children.

If you are a parent or guardian and believe your child has uploaded personal information to the Services in violation of applicable law, you may contact us as described in “Contact Us” below.

The Services may contain links to other websites/applications and other websites/applications may reference or link to our Services. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk.
