Potential Winner Requirements1) In order to win a prize, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release within five (5) business days. Sponsor will work with potential winner to pick an area suitable to build a rain garden.  If no location is found to be suitable, or if building a rain garden on the potential winner’s property is not feasible for any reason, the second place winner based on the number of points received in the contest judging in each category may be selected. Final location selection is at the discretion of the Sponsor in consultation with the potential winner.

Prizes:  Each winner will have a rain garden designed and installed on their property by the Sponsor.  The rain garden is valued at $550.  A rain garden is a garden of native perennials, and flowers planted in a small depression that allows rainwater runoff from impervious urban areas, like roofs, driveways, walkways, parking lots, and compacted lawn areas, the opportunity to be absorbed.  Construction of rain garden will be coordinated and completed by Sponsor.  Sponsor may use volunteer support to help install the rain garden.  Sponsor will assist winners in site selection, design criteria.  The rain gardens installed will be an average of 100 ft2 or less and will be determined based on site restrictions and water flows on site.  Rain gardens will be installed in Fall 2013.  Each winner is responsible for paying any income taxes and any and all other costs and expenses not listed above. Any prize details not specified above will be determined by Sponsor, in its sole discretion. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion.

Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than  New Jersey.
