Eligibility: The Contest is open only to authorized representatives of tax-exempt or nonprofit entities located in Hunterdon, Mercer, Middlesex, Morris, or Somerset counties in New Jersey, U.S. (“Entrant”). Employees of The Nature Conservancy, Johnson & Johnson Services Inc., and the Johnson & Johnson Family of Companies Foundation as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter.
Sponsor: The Contest is sponsored by The Nature Conservancy in New Jersey, 200 Pottersville Road, Chester, NJ 07930 (“Sponsor”).
Entry Period: The Contest begins at 9 A.M. (EST) on Wednesday, May 8, 2013 and ends at 11:59 P.M. (EST) on Saturday, June 8, 2013 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Contest. Mailed entries must be postmarked on or before June 8 to be eligible.
How to Enter:
1) Complete an Entry Form: Print and complete an entry form located at www.nature.org/showusyourh2o-entryform (the “Website”).
2) Use creativity to answer the following question: Where does your water come from? Acceptable submission formats include: creative or technical writing (e.g. reports, short story, cartoon/graphic novel and poetry), visual art (e.g. photography, drawing, painting, prints/etchings and collage), 3-D (e.g. diorama and sculpture), story or project boards, multi-media (e.g. PowerPoint and graphic design) and mapping (“Submission”). Video and audio entries will not be accepted. Photographs of children under age 13 will not be accepted.
3) Submit your Entries: Send the completed form along with your Submission to The Nature Conservancy, Attn: Show Us Your H2O, 2350 Route 47, Delmont, NJ 08314 OR submit the form and your Submission via email at email@example.com. You will receive one (1) entry per Sumbission that complies with the requirements in these Official Rules. There is no limit to the number of entries you may submit. Select entries received will be posted on the website: www.nature.org/showusyourh2o.
4) Representations and Warranties: By entering, you represent and warrant that: (i) you accept these Official Rules and Sponsor’s decisions regarding the Contest; (ii) you own all rights to your Submission; and (iii) if a picture depicts any person other than yourself, you have written permission from that person to grant the rights described in the “Sponsor’s Rights to Submissions” section below, and can provide that permission to Sponsor upon request.
5) Digital Member: When you enter, you will automatically become a digital member of The Nature Conservancy. This membership includes special event invitations and a monthly e-newsletter. There is no cost for this membership and you may cancel and unsubscribe at any time.
Sponsor’s Rights to Submissions: You do not transfer any ownership of a Submission by entering the Contest. However, by entering, you: (a) irrevocably grant Sponsor, its agents, licensees, and assigns the unconditional and perpetual (non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Submission as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude Sponsor’s use of your Submission, or require any further permission for Sponsor to use the Submission; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor on the grounds that any use of the Submission, or any derivative works, infringes any of your rights, including, without limitation, copyrights, trademark rights, and moral rights.
Judging: On or about June 12, 2013, Sponsor will select two (2) potential winner(s). One winner will be selected from a “School” Category and one winner will be selected from a “Civic” Category. Entries received from tax-exempt institutions for learning for any grade including charter and private schools will be entered into the School Category. All other tax-exempt organizations or non-profit organizations will be entered into the Civic Category. Potential winners will be selected through a judging process (described below) of all entries received. Sponsor will attempt to notify potential winners within 2 (TWO) business days of the completion of the Judging Process.
Judging Process: A panel will be selected by The Nature Conservancy at its sole discretion. Entries will be judged by the panel according to the criteria listed below. Points will be awarded in each criteria based on the sole discretion of judges. The projects with the highest number of points in the School and the Civic category will be the potential winners.·
Creativity and originality: Entry attempts to use creativity, artistic expression and innovation when conveying their message.
Content of message: Entry clearly addresses and answers contest questions.
Technical accuracy: Research is accurate and informative.
Visual quality: All visuals and text are easily understood; all visual effects contribute to rather than distract from the underlying message.
Winner Notification: Sponsor will attempt to notify the winners by email by June 12, 2013.
Potential Winner Requirements: 1) In order to win a prize, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release within five (5) business days. If a potential winner fails to sign and return these documents within the required time period, the second place winner based on the number of points received in the contest judging in each category may be selected. Only three (3) alternate potential winners may be contacted for each prize. Potential Winners must own, control or operate property large enough to accommodate a rain garden on which they have authorization to build a rain garden. Potential Winners are responsible for obtaining any and all necessary permissions, licenses, and permits to build a rain garden. Sponsor will work with potential winner to pick an area suitable to build a rain garden. If no location is found to be suitable, or if building a rain garden on the potential winner’s property is not feasible for any reason, the second place winner based on the number of points received in the contest judging in each category may be selected. Final location selection is at the discretion of the Sponsor in consultation with the potential winner.
Prizes: Each winner will have a rain garden designed and installed on their property by the Sponsor. The rain garden is valued at $550. A rain garden is a garden of native perennials, and flowers planted in a small depression that allows rainwater runoff from impervious urban areas, like roofs, driveways, walkways, parking lots, and compacted lawn areas, the opportunity to be absorbed. Construction of rain garden will be coordinated and completed by Sponsor. Sponsor may use volunteer support to help install the rain garden. Sponsor will assist winners in site selection, design criteria. The rain gardens installed will be an average of 100 ft2 or less and will be determined based on site restrictions and water flows on site. Rain gardens will be installed in Fall 2013. Each winner is responsible for paying any income taxes and any and all other costs and expenses not listed above. Any prize details not specified above will be determined by Sponsor, in its sole discretion. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion.
General Conditions: In the event that the operation, security, or administration of the Contest is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prize(s) at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. The Contest is subject to federal, state, and local laws and regulations and is void where prohibited.
Release and Limitations of Liability: By participating in the Contest, you agree to release and hold harmless Sponsor, its parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New Jersey. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New Jersey.
